Mach 3 Speed Training – Dealer Agreement
By checking the box labeled “Agree to our Terms of Use” during affiliate registration, you agree to the following terms with Warp Drive Golf Speed Training, LLC (“Mach 3”):
- Appointment & Scope – You are appointed as a non-exclusive dealer of Mach 3 products. This does not grant exclusive rights, and Mach 3 may appoint other dealers or sell directly.
- Term & Termination – This Agreement begins when you accept it and remains in effect until terminated. Either party may terminate with 30 days’ written notice. Mach 3 may terminate immediately for harmful conduct, brand misrepresentation, violation of pricing policies, or other material breach.
- Dealer Obligations – You agree to use best efforts to promote, market, and sell Mach 3 products. You are responsible for ensuring your customers use your assigned code or affiliate link at the time of purchase. Orders not tracked at checkout will not be credited retroactively.
- Mach 3 Obligations – Mach 3 will provide you with a unique code and affiliate link for tracking. Mach 3 will maintain accurate sales records and provide reports as reasonably requested.
- Pricing & Delivery – Product pricing is maintained on the Mach 3 website. You may not advertise, promote, or list products at prices lower than those set by Mach 3. All customer orders are submitted via the Mach 3 website, and Mach 3 will make commercially reasonable efforts to fulfill them in a timely manner.
- Commissions – You will receive a commission of 15% on qualifying sales made with your assigned code or link. Commissions are only payable once orders are paid in full and fulfilled, and will be issued within 30 days following the end of the month of fulfillment.
- Intellectual Property – All trademarks, copyrights, and intellectual property related to Mach 3 products remain the property of Mach 3. You may use Mach 3 branding only as necessary to promote and sell products under this Agreement.
- Confidentiality – Both parties agree to keep confidential any proprietary or sensitive information exchanged under this Agreement.
- Governing Law & Disputes – This Agreement is governed by Texas law. Any disputes not resolved by good-faith negotiation will be submitted to binding arbitration in Tarrant County, Texas.
- Miscellaneous – This Agreement is the complete agreement between you and Mach 3. No assignment of rights is permitted without Mach 3’s prior consent. If any provision is found unenforceable, the remainder will continue in effect.
By checking the box to agree to these terms, you acknowledge that you have read, understood, and agree to be bound by the Mach 3 Dealer Agreement.
